Solution
If you think that your neighbour has encroached, or is about to encroach, across the boundary between your properties, you may have grounds for taking legal action.
Litigation, however, can be an expensive business and should never be undertaken lightly. Initial advice from an experienced chartered surveyor can save a lot of expense and heartache, if taken early enough.
If your neighbour has encroached on your land then the services of a solicitor will almost always be required. The solicitor, however, will need assistance and advice from a qualified and experienced surveyor.
In these cases it is usually better if the surveyor is instructed by the solicitor on your behalf.
