Problem

I want to build on a boundary. What do I have to do?

Solution

If you intend to build on, or perhaps close to, a boundary, then you may have to first give notice to all the Adjoining Owners. There could be several ”adjoining owners” for each neighbouring property.

If the neighbours consent, you may simply continue with the work when the notice period has expired. You can gain the right to enter their land to carry out the work. This can include encroaching on their land with your foundations.

If a dispute arises in connection with your proposed work , then one or more surveyors will have to be appointed to resolve it under the Party Wall Act 1996.

If you intend to use reinforced concrete foundations you must have the consent of your neighbours.

An experienced party wall surveyor can handle all of the initial statutory formalities on your behalf – often for a fixed fee.
