Problem

I have received a 3/6 metre Notice. What should I do now?

Under the Party Wall Act 1996, if one of your neighbours wishes to excavate to build foundations below the level of your foundations (within 3 metres), or below a line at a 45 degree angle from your foundations (within 6 metres), they have to give you notice and details of the work they intend to carry out. They will also have to tell you what steps they will take to protect the stability of your property.

You will want to ensure that the appropriate works are taken to safeguard your property from damage. You will also need to record the condition of your property before work starts.

The Act provides for you to appoint a surveyor. He or she will take the appropriate steps under the Act to see that your rights are protected. As a first step you can call either Tony Kay or Dianne Green on 0114 276 7074 to discuss the position as it specifically applies to you.

Your surveyor’s fees will normally be paid by your neighbour.
