Problem

I have received a Line of Junction Notice. What should I do?

Solution

Under the Party Wall Act 1996, if one of your neighbours wishes to build on the boundary between your properties, they should give you notice. Unlike Party Structure Notices, you do not have to consent or dissent. If you do nothing then your neighbour will simply go ahead with the work.

They may, however, have a right to enter onto your property to carry out some of the work.

Obviously you will want to make sure that appropriate steps are taken to safeguard your property from damage. You will need a record of the condition of the premises before work starts.

The Act provides that you can appoint a surveyor. He or she will take the appropriate steps to ensure that your rights are protected.

Your surveyor’s fee will normally be paid by your neighbour.
