Problem

I have received a Party Structure Notice. What should I do now?

Solution

Under the Party Wall Act 1996, if one of your neighbours wishes to carry out certain work to a structure that they share with you (e.g. a wall or floor separating your properties) they should give you notice and allow you time to consent or dissent. If you do not respond within 14 days you will be deemed to have dissented.

Obviously, you will want to make sure that appropriate steps are taken to safeguard your property from damage. You will also need a record of the condition of your property before the work starts so that any damage that may occur can be clearly identified. It will be up to your neighbour to pay for repairs.

The Act provides for you to appoint a surveyor. He or she will take the necessary steps under the Act to see that your rights are protected.

Your surveyor’s fee will normally be paid by your neighbour.
