I have received a notice of increase in my rent

Solution

Most modern leases provide for the landlord to be able to review the rent on a business tenancy at regular intervals, usually 3 or 5 yearly.

The lease will usually set out a timetable as to when he can serve the notice and what the tenant must do when he receives it. In our experience there are as many differently worded rent review clauses as there are leases and some require a strict and formal procedure to be adhered to.

The increase proposed by your landlord can and should be challenged, to ensure that all the relevant rental evidence can be gathered and presented as part of the argument for a lower figure to be agreed.

If agreement cannot be reached most leases will provide for the dispute to be resolved by an independent third party who will act as an expert or arbitrator.
