The occupation and use of property for commercial and industrial purposes can be fraught with many problems.

On the one hand, a leaseholder occupies his or her premises on the terms of a lease or agreement which, amongst other things, imposes obligations regarding the payment of rent and terms for its review, usually to a higher figure, from time to time. It may also require the occupant to undertake all, or at least part, of the repairs which will become necessary throughout the length of the lease. The occupation of nearly all premises also brings an unwelcome liability for the payment of business rates.

A freeholder, on the other hand, has a similar liability to local taxation, but may be more concerned about a property’s value for accounting purposes or as security for a loan. It is certain that the building will require repairs at some stage in its life and it is always wise to attend to those repairs at an early stage, or better still, instigate a planned programme of maintenance.

It is likely that both categories of occupier will wish to carry out alteration or extension works at some point in the lifetime of the building.
