New Building Regulations Part M Provisions
Coming into Effect in October 1999

Most of the effects of the Disability Discrimination Act 1995 have been felt throughout the property world. Statutory controls now ensure that owners and managers of existing buildings do not discriminate against people with disabilities.

Where existing buildings need alterations, the likely date for compliance is 2004.

One further change coming into view is the substitution of Part M of the Building Regulations 1991. This will have the effect of including new dwellings and will apply where erection is begun after 25th October 1999. This may apply even if the plans have been deposited before that date but not unconditionally passed before 1st June.

All building owners, developers, landlords, service providers and employers should also already be considering having an access audit carried out on their buildings.

Disabilities which will have to be considered include:

mobility problems and other physical impairment, sensory impairment including limited sight, and hearing problems
